Precedent & Statutory Rationale

1. Revival of the Upper House:

o The original Legislative Council of Andhra Pradesh, established in 1958, was abolished in May 1985 through the Andhra Pradesh Legislative Council (Abolition) Act, 1985.

o Following a renewed political consensus and a formal resolution passed by the Andhra Pradesh Legislative Assembly, steps were initiated to recreate the upper house to ensure broader public participation, deeper legislative scrutiny, and representation for local bodies, educators, and graduates.

2. Constitutional Mechanism (Article 169):

o The legislation was enacted pursuant to Article 169 of the Constitution of India, which empowers Parliament to create or abolish a State Legislative Council by law if the concerned Legislative Assembly passes a resolution supporting it by a special majority.
