Precedent & Historical Rationale

Proliferation of Objectifying Media:

Prior to the mid-1980s, the rapid expansion of print media, advertisements, billboards, and cinema saw an increasing trend of portraying women in an overtly derogatory, explicit, and indecent manner. Existing laws, such as general provisions under the Indian Penal Code (like obscenity under Section 292), were found to be broad, reactive, and insufficient to deal specifically with the commercial exploitation and objectification of women's figures and bodies in public media.

Social Advocacy and Legislative Intent:

Responding to persistent demands from women's rights organizations, social reformers, and public opinion, the government recognized that indecent representation undermines human dignity, promotes voyeurism, and negatively impacts societal attitudes toward gender equality. Consequently, Parliament enacted a specialized statute to outrightly ban the indecent representation of women through advertisements, publications, writings, paintings, figures, or any other media.
