Precedent & Historical Rationale

Untapped Potential of Inland Water Transport:

Despite possessing an extensive network of rivers, canals, backwaters, and creeks spanning thousands of kilometers, India’s inland water transport system remained heavily underutilized. Prior to 1985, responsibility for developing and regulating waterways was fragmented across various state and central agencies without a dedicated, centralized expert body to coordinate policy, plan infrastructure, or direct investments for shipping and navigation.

Need for a Specialized Statutory Body:

Recognizing the cost-effectiveness, fuel efficiency, and eco-friendly nature of water transport compared to congested rail and road networks, the Government felt an urgent necessity to create a specialized national apex body. Modelled similarly to authorities governing ports and railways, this institution was conceptualized to exclusively manage, regulate, and develop national waterways and foster private or public-private cooperation in inland shipping.

Parliamentary Trajectory & Enactment

Formulation:

Drafted by the Ministry of Shipping to establish the Inland Waterways Authority of India (IWAI) as a statutory body corporate endowed with powers to survey economic feasibility, construct infrastructural facilities (such as terminals, navigational channels, and storage), and advise the Central Government on matters related to inland water transport.

Parliamentary Passage:

Introduced and debated across both Houses of Parliament (Lok Sabha and Rajya Sabha) during the winter session of 1985, successfully securing legislative approval.

Presidential Assent:

Received Presidential Assent on December 30, 1985.

Enforcement: Enforced on October 27, 1986.
