Summary
Summary of the National Waterways Act, 2016
Objectives of the Act
• To declare specified inland waterways as National Waterways.
• To facilitate the development and maintenance of inland water transport infrastructure.
• To promote safe, efficient, and sustainable movement of passengers and cargo.
• To improve multimodal connectivity and support economic and regional development.
Key Provisions
• Declaration of National Waterways: The Act declares 111 inland waterways as National Waterways, as specified in the Schedule to the Act.
• Unified Legal Framework: It repeals the five earlier Acts that separately declared individual waterways as National Waterways, thereby creating a single, comprehensive legislative framework.
• Development of Waterways: The declaration enables the Central Government, principally through the Inland Waterways Authority of India (IWAI), to undertake the development, regulation, and maintenance of National Waterways for navigation.
• Infrastructure Development: The Act facilitates the development of navigation channels, terminals, jetties, navigational aids, and other infrastructure required for inland water transport.
• No Automatic Development or Land Acquisition: The declaration of a waterway as a National Waterway does not by itself mandate its development or authorize land acquisition. Such activities are undertaken separately in accordance with applicable laws and subject to technical, environmental, and financial feasibility.

Precedent & Statutory Rationale
1. Underutilization of Eco-Friendly and Cost-Effective Inland Transport:
o Prior to 2016, India possessed thousands of kilometers of navigable rivers, canals, backwaters, and creeks, yet inland water transport accounted for a minuscule fraction of national freight and passenger movement. High logistics costs, fragmented state regulations, and a lack of centralized funding hampered sector growth compared to roads and railways.
2. Comprehensive Expansion under Entry 24 of the Union List:
o Grounded in the constitutional mandate under Entry 24 of the Union List (Seventh Schedule)—which empowers Parliament to legislate on shipping and navigation on inland waterways declared to be national waterways—the legislation was enacted to drastically scale up infrastructure, reduce carbon footprints, and lower freight transit costs across industrial corridors.
Parliamentary Trajectory & Enactment
