Summary
Summary of the Parliamentary Proceedings (Protection of Publication) Act, 1977
Objective
The Parliamentary Proceedings (Protection of Publication) Act, 1977 was enacted to protect the publication of substantially true reports of the proceedings of Parliament. The Act ensures that newspapers, news agencies, and broadcasting organisations can report parliamentary proceedings without fear of civil or criminal liability, provided such publication is made in good faith, is substantially accurate, and is in the public interest. It restored the protection that had been withdrawn during the Emergency.
Key Provisions
• Protection for Publication: Grants immunity from civil or criminal proceedings for publishing a substantially true report of the proceedings of either House of Parliament, unless the publication is proved to have been made with malice.
• Public Good Limitation: The protection does not extend to the publication of any matter that is not for the public good.
• Definition of Newspaper: Defines "newspaper" to include any printed periodical containing public news or comments on public news, and includes news agencies supplying material for publication.
• Broadcast Coverage: Extends the same legal protection to reports of parliamentary proceedings broadcast by wireless telegraphy (now applicable to broadcasting services).
• Retrospective Commencement: The Act was enacted on 18 April 1977 but is deemed to have come into force retrospectively from 25 March 1977.
