Precedent & Historical Rationale

● Inadequacy of Criminal Penal Provisions (Section 498A IPC) and Civil Law Gaps - Prior to 2005, civil remedies for domestic abuse were largely restricted to matrimonial relief such as judicial separation or divorce, while criminal remedies under Section 498A of the Indian Penal Code focused strictly on matrimonial cruelty and dowry harassment. This criminal framework lacked emergency civil protections, leaving battered women vulnerable to immediate homelessness and economic destitution without emergency injunctions against dispossession, protection orders against contact, or monetary support while remaining in the matrimonial home.

● Comprehensive Civil-Criminal Statutory Remedy and International Commitments - In line with the UN Convention on the Elimination of All Forms of Discrimination Against Women (CEDAW) and the Beijing Declaration (1995), the Act was formulated to provide a comprehensive, rights-based civil remedy with criminal penalties for non-compliance. As detailed on India Code, the statute codified an expansive definition of domestic violence (covering physical, sexual, verbal, emotional, and economic abuse), recognized rights to reside in a shared household, and empowered Magistrates to issue ex-parte Protection Orders, Residence Orders, Custody Orders, and Monetary Relief, supported by institutional infrastructure comprising Protection Officers and registered Service Providers.

Parliamentary Trajectory & Enactment

● Formulation & Earlier Legislative Efforts - Drafted by the Ministry of Human Resource Development (Department of Women and Child Development) following extensive consultative drafts prepared by the Lawyers Collective and civil society groups, replacing an earlier lapsed measure (The Protection from Domestic Violence Bill, 2002).
