Precedent & Historical Rationale
1. Severe Internal Security Crisis in Punjab:
o During the early 1980s, the State of Punjab witnessed an unprecedented surge in violent extremist activities, separatist insurgencies, and terrorist violence, leading to a complete breakdown of civil administration and law and order.
o Standard legal provisions under the Code of Criminal Procedure, 1973, were inadequate for security forces to effectively contain, deter, and combat the heavily armed militant networks operating across the state.
2. Special Statutory Powers for Security Forces:
o The legislative intent centered on empowering the Governor of Punjab or the Central Government to officially declare the whole or any part of the State of Punjab as a "disturbed area."
o This designation vested police officers (and later extended to armed forces deployed in aid of civil power) with extraordinary legal authority, including the power to fire upon or use force against persons acting in contravention of law, and to conduct searches and arrests without warrants to restore public safety and sovereignty.
